Justice Rachael Aiteseme Ogbevoen of the Edo State High Court sitting in Benin City on Friday admitted to a ₦5 million bail one Osaze Adùn, popularly known as “Kapuepue,” charged with alleged assault, harassment and brutalisation of renowned Nollywood filmmaker and media executive, Dr Don Pedro Obaseki, an offence the Department of State Services (DSS) classified as an act of terrorism.
The presiding judge had at the request of the DSS, initially ordered that the defendant be remanded in prison for 14 days pending the advice of the Director of Public Prosecution (DPP).
Newsmata.com.ng reports that Dr. Obaseki, cousin of the immediate past governor of the state, Godwin Obaseki, was allegedly accosted on Sunday December, 28, 2025, morning at the popular Uwa Primary School football field in Benin while playing football, stripped to his boxers, and dragged through the streets to the palace of the Benin monarch, Oba Ewuare 11 for allegedly disrespecting him.
But following a motion for bail argued by his counsel, Olayiwola Afolabi, senior advocate of Nigeria, (SAN) who led a team of six other lawyers, Justice Ogbevoen, in a short ruling, admitted the defendant to bail with one surety in like sum.
The surety, the court held, must be a civil servant on Grade Level 12 and above and resident within the court’s jurisdiction.
The judge further ordered the defendant to appear in court on every last Friday of the month pending advice from the Director of Public Prosecutions (DPP).
Olayiwola had argued that the alleged offence was bailable and urged the court to exercise its discretionary powers in line with the defendant’s fundamental rights.
Meanwhile, counsel to Dr Obaseki, Femi Falana, (SAN) had earlier disclosed that the secret police had taken over the investigation.
According to Falana, following escalation by his chambers, the DSS headquarters assumed conduct of the probe “in recognition of the nature, gravity and implications of the acts complained of.”
Falana described the decision to classify the matter as terrorism related as “commendable,” noting that it underscored the seriousness with which the authorities were treating the alleged acts.
The public humiliation and dehumanisation of the former managing director of DAAR Communications Ltd had sparked widespread outrage with calls on him by concerned Nigerians to seek redress in court.
The seasoned journalist, on Sunday January 18, 2026, announced his decision to take legal action against his assailants.
In a statement, he said the decision was taken after extensive consultations with his wife and children, members of the Obaseki family and clan, senior legal advisers and respected elders.
Obaseki insisted that the move was not driven by revenge or political motives, but by the need for accountability, deterrence and the protection of human dignity.
